‘Cow substitute to mother and God’: HC judge directs AP and Telangana govt to make cattle killing non bailable offence

Days after Rajasthan High Court recommended that Cow should be declared as the national animal of India, a Hyderabad high court judge on Friday called the cow a “substitute to Mother and God”. Justice B Siva Sankara Rao made the statement while dismissing the petition of a cattle trader from whom 63 cows and two bulls were captured.

While announcing the order, Justice Rao said, “Whether a person is entitled to claim interim custody of cows and bulls seized from him when he was allegedly taking them to a slaughter house? This question needs to be posed and answered in view of the national importance of cows which are substitutes to Mother and God”.

63 cows and two bulls were seized from one Ramavath Hanuma, a cattle trader. He claimed that he brought these cows to Kanchanapalli village for grazing. He approached a trial court in Nalgonda which rejected his petition for custody of 65 bovines. Hanuma then moved to High Court where Justice B Siva Sankara Rao rejected his petition saying that he cannot interfere in trial court’s order. The prosecution has alleged that Hanuma brought 65 bovines from a farmer for the purpose of slaughtering them on the occasion of Bakrid.

In Andhra and Telangana, cow slaughter is permitted if the cows are approved by the veterinary doctors to be old and unproductive. Justice Sankara Rao also stated that those vets who certify healthy cows as unfit should be booked under the penal net of the AP Cow Slaughter Act, 1977.

The Hyderabad HC has given a month’s time to Andhra Pradesh and Telangana govt to make the act of mischievously killing or maiming cattle a non-bailable offence by amending Section 429 of the Indian Penal Code.
