Unemployed husband don’t need to pay alimony to his working wife, Hyderabad High Court ruled setting aside a lower court’s order that had ordered the husband to pay Rs 4000 per month as alimony.The landmark order came from the bench of Justice B Siva Sankara Rao on a review petition filed by one B Mahanti Ranjit Kumar of Srikakulam district of Andhra Pradesh.
Earlier, a family court in West Godavari district has ordered Kumar to pay a month maintenance of Rs 4000. The woman was reportedly employed in a government hospital as a clinical psychologist.Times of India reported that wife told the court that they got married in Srikakulam on March 12, 2012, and that her parents gave the husband’s family five sovereigns of gold and Rs 6 lakh as dowry. The woman also alleged that barely five day after their union the husband started harassing her; he checked messages in her phone and monitored her calls besides he also demanded additional dowry of Rs 3 lakh.
Subsequently, the woman filed for divorce and sought a maintenance of Rs 10,000 from his salary as lecturer. However, the man expressed his inability to pay alimony saying he was unemployed and earned money from giving tuitions. He also alleged that he woman was married off against her will, and used to talk with another person on the phone regularly. He also said that woman was well off and can take of herself.
