Triple talaq hearing live updates: Supreme Court won’t hear ‘polygamy’, will only examine ‘triple talaq’ & ‘Nikah halala’

A batch of pleas have been submitted in the Supreme Court to challenge the constitutional validity of the practice of 'triple talaq'

The Supreme Court has begun a marathon hearing of a batch of pleas submitted in the apex court challenging the constitutional validity of the practice of ‘triple talaq’, ‘nikah halala’ and polygamy in Muslims. A five-judge Constitution bench is hearing the pleas. The bench is headed by Chief Justice of India (CJI) Jagdish Singh Khehar and four other judges, namely Justices Kurian Joseph, Rohinton Fali Nariman, Uday Umesh Lalit and S Abdul Nazeer. All the five judges hearing the case belong to different faiths.

Here are the live updates of the case:

1:30 pm: The main issues being considered by SC include: whether Triple talaq is fundamental to religion, and are there enforceable fundamental rights

1:00 pm: Bench rises for lunch, the case will be heard after 2 pm.

12:45 pm: Appearing for All India Muslim Personal Law Board, Kapil Sibal has said that triple talaq is outside the purview of judicial review.

12:30 pm: Supreme Court says it will decide on the issue of constitutional validity of triple talaq

11: 40 am: Will examine whether triple talaq is fundamental to religion or not, says Supreme Court

11: 25 am: Supreme Court makes it clear that it is not going to hear polygamy issue in the triple talaq case.

10:55 am: SC says it will keep matter limited to whether triple talaq and halala are fundamental to the religion or not

10: 50 am: Petitioner Farah Faiz says that “Triple talaq is anti-Islam. There is no description of triple talaq in the holy Quran. Triple talaq is a form of abuse.”

10: 45 am: The Supreme Court has said that it will not be hearing the cases of poligamy during its ‘marathon hearing’, will only hear the issue of ‘triple talaq’ and ‘Nikak Halala’. It says that polygamy is not related to triple talaq.

## Supporting an end to triple talaq, the Allahabad High Court had earlier said that the rights of any person, including Muslim women, cannot be violated in the name of ‘personal law’. The Allahabad High Court had also termed the Islamic practice of divorcing a woman by saying “talaq” thrice as “unconstitutional”.

## The apex court had in April said that it will hear and resolve the debate on triple talaq “once and for all.”
