A five-judge bench of Supreme Court belonging to different communities has begun its hearing on separate pleas arguing the validity of the practice of triple talaq, polygamy, and Nikaah Halala on May 11. The apex court is making efforts to identify if triple talaq is really an integral part of Islam as claimed by the Muslim Law Board.
However, the top court will not hear petitions pertaining to polygamy asserting that it was not related to triple talaq. CJI J.S. Khehar (Sikh), Justice Kurian Joseph (Christian), Justice Rohinton Nariman (Parsi), Justice Uday Lalit (Hindu) and Justice Abdul Nazeer (Muslim) are the judges presiding over the cases.
Prime Minister Narendra Modi had recently come out to condemn the practice of triple talaq and asserted that no one was above the law. “I’m hopeful that Muslim intellectuals will come forward to fight against the injustices meted out to Muslim women due to ‘triple talaq,” PM said.
During television interviews, Maulanas have claimed that the government should not interfere with the religion adding that Muslims were satisfied, but contradicting them, the Muslim women have asserted that they should be given equal rights.
